These Terms of Service (“Terms”) govern your use of our website, services, and booking platform (collectively, the “Services”) provided by Holi House. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Our Services
Holi House connects guests with hosts to book unique accommodations. We act as an intermediary platform and are not a party to the rental agreement between guests and hosts. Each listing’s terms, including pricing, availability, and house rules, are set by the host.
2. Eligibility
To use our Services, you must be at least 18 years old and capable of entering into a legally binding agreement. You may not use our Services if your account has been suspended or if prohibited by law.
3. Booking and Payment
- Reservations: When you book a stay, you agree to the listing’s terms, including pricing, cancellation policy, and house rules set by the host.
- Payment: Payments are processed securely through our platform. You authorize Holi House to charge the total amount (including fees and taxes) at the time of booking unless otherwise stated. Hosts receive payouts after your check-in, minus applicable service fees.
- Currency: All transactions are in the currency specified in the listing.
4. Cancellations and Refunds
Cancellations are subject to the host’s cancellation policy unless our Extraordinary Circumstances Policy (#) applies (see our Cancellation Policy for details). Holi House does not guarantee refunds outside these terms and is not responsible for agreements made directly between guests and hosts.
5. User Responsibilities
- Guests: You agree to respect the property, follow house rules, and communicate promptly with your host. You are responsible for any damage caused during your stay.
- Hosts: You agree to provide accurate listing details, maintain your property in a safe and habitable condition, and honor confirmed bookings. Misrepresentation may result in penalties, including removal of your listing.
- General: You must not use our Services for illegal purposes, harass others, or post harmful or misleading content.
6. Holi House’s Role
We facilitate bookings but are not responsible for the condition of properties, host-guest interactions, or damages. Disputes between guests and hosts should be resolved directly, though we may assist as a mediator if requested.
7. Fees
Holi House charges service fees to guests and/or hosts for using our platform. These fees are disclosed during the booking process and may vary based on the reservation.
8. Intellectual Property
All content on our platform, including text, images, and logos, is owned by Holi House or its licensors. You may not copy, distribute, or use it without permission, except for personal, non-commercial use related to your booking.
9. Limitation of Liability
To the fullest extent permitted by law, Holi House is not liable for indirect, incidental, or consequential damages arising from your use of our Services, including but not limited to property damage, personal injury, or loss of data. Our total liability shall not exceed the amount you paid us for the relevant booking.
10. Termination
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or at our discretion with notice. Upon termination, you lose access to our Services, though existing bookings may still be honored at our discretion.
11. Changes to These Terms
We may update these Terms from time to time. We’ll notify you of significant changes via email or on our website. Your continued use of our Services after updates constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of this country. Any disputes will be resolved in the courts of this country.
